Retraction, Withdrawal, Correction, and Removal Policy
The Editorial Board of Jurnal Hukum Pidana Indonesia recognises that authors invest substantial time and effort in preparing their manuscripts, and that all submissions undergo a rigorous peer-review process. Nevertheless, situations may arise in which an article must be withdrawn, corrected, retracted, or removed for scholarly, ethical, or legal reasons. Such actions are undertaken with caution and only under clearly defined conditions.
Jurnal Hukum Pidana Indonesia is committed to maintaining the integrity, transparency, and reliability of the scholarly record. All post-publication actions follow recognised best practices, including the guidelines of the Committee on Publication Ethics (COPE).
- Article Withdrawal
Article withdrawal applies only to manuscripts that are still in the Articles in Press stage (accepted but not yet formally published with complete bibliographic details).
Withdrawal may be conducted under the following circumstances:
- The article contains significant errors identified prior to formal publication;
- The article has been accidentally submitted or published more than once (duplicate submission);
- The article violates ethical standards, including but not limited to plagiarism, false authorship claims, or fraudulent data use.
A withdrawn article will be removed from the online system and replaced with a notice indicating that the article has been withdrawn, along with a reference to the applicable withdrawal policy.
Authors may request withdrawal only during the submission or peer-review stages. Once a manuscript has been formally accepted and publication agreements have been signed, withdrawal is no longer permitted.
- Article Retraction
Retraction is issued to correct the scholarly record and ensure its integrity. Retraction may occur under the following conditions:
- There is clear evidence that the findings are unreliable due to misconduct (e.g., data fabrication or falsification) or serious error;
- The article constitutes redundant or duplicate publication;
- There are significant ethical violations, including plagiarism, improper authorship, or misuse of data.
Retraction procedures follow COPE guidelines and include:
- Concerns raised to the editorial board;
- Evaluation of the case, including author clarification;
- Communication of the final decision to authors and relevant institutions;
- Publication of a retraction notice.
The retraction notice will:
- Be titled “Retraction: [article title]”;
- Be published in a subsequent issue of the journal;
- Provide clear reasons for retraction;
- Be electronically linked to the original article.
The original article will remain accessible but will be clearly marked as “retracted” (e.g., watermark on each page), while the HTML version may be removed or replaced with the retraction notice.
Authors do not have the automatic right to retract their published work, as the integrity of the scholarly record takes precedence.
- Article Correction
Corrections are issued when an article remains valid but contains errors that may affect interpretation or accuracy.
Corrections may include:
- Erratum (Publisher Correction): for errors introduced during the editorial or production process;
- Corrigendum (Author Correction): for errors made by the author(s);
- Addendum: for additional information or clarification that enhances the original work.
The decision to issue a correction is made by the Editor(s), sometimes in consultation with reviewers or Editorial Board members. Authors may be contacted for clarification, but the final decision rests with the journal.
- Article Removal
Article removal is applied only in exceptional circumstances, such as when:
- The content is defamatory;
- The article infringes legal rights;
- The article is subject to a court order;
- The content poses a serious risk to public health or safety.
In such cases:
- The article’s metadata (title and authorship) will be retained;
The full text will be removed and replaced with a notice stating that the article has been removed for legal or ethical reasons.
